2011 drunken driving case moves to closure

    A 2011 drunken driving case is moving to closure following a hearing Friday in Dawson County District Court.   Javier Urbina-Montes of Oxford was arrested by officers of the Lexington Police Department on September 17, 2011 along Highway 30 on the eastern edge of Lexington.   His vehicle was parked on the side of the Highway and as officers approached the vehicle they detected an alcoholic beverage.   As their investigation continued at the Police Department, they obtained a breath test of .266.  Urbina-Montes was arrested on suspicion of DUI- 5th offense and driving while license was revoked.

    Urbina-Montes was arraigned in Dawson County Court but failed to appear for a subsequent hearing and an arrest warrant was issued in September 2011. 

    Urbina-Montes wasn’t located until last October(2021) when he was arrested by the Harlan County Sheriff’s Office for several charges including drunken driving.  That case was resolved in Harlan County Court with conviction on a reduced charge of Driving Under the Influence.  He was sentenced to 60 days in jail but was given credit for 88 days he already served.  His driver’s license was also revoked for one year.

      Following the resolution of the Harlan County case, Urbina-Montes, now 53, was returned to Dawson County for his 2011 case.   It was bound over to Dawson County District Court and on Friday, Urbina-Montes pled guilty to a reduced charge of Driving Under the Influence and Driving Under Revocation.  Because the charges are felonies, Urbina-Montes faces a penalty of one to 20 years imprisonment and up to $25,000 fine when he is sentenced in Dawson County District Court on August 29, 2022 at 8:30am.  He was previously released after posting 10% of a $25,000 bond, which was continued.
