Two arraigned in Custer County District Court Thursday

BROKEN BOW – Two people were arraigned on felony charges Thursday morning in Custer County District Court.

Tim Rosentrater of Callaway was arrested in February on a sexual assault charge. In January a woman told police that she suffers from a medical condition which leaves her in a vulnerable state and came to awareness on two occasions to find Rosentrater sexually assaulting her.

Late last week more than a dozen additional charges were filed against Rosentrater for assaults dating back as far as 2001 involving five different women, some of whom were 15 or younger at the time.

In all, Rosentrater was charged with four counts of First Degree Sexual Assault, one count each of Second and Third Degree Sexual Assault and eight counts of Sexual Assault of a Child.

Rosentrater did not enter a plea on Thursday as his attorney, Matthew Furrow, requested a preliminary hearing on the new charges. That hearing was set for the afternoon of June 27.

Meanwhile, John Anderson V of Arapahoe pleaded not guilty to charges of motor vehicle homicide and willful reckless driving.

Anderson’s case stems from a fatal accident that happened Aug. 18, 2023, on Highway 2 southeast of Anselmo.

According to an arrest affidavit, the Custer County Sheriff’s Office said Anderson was driving a semi eastbound on the highway when he crossed the white line onto the shoulder of the road. The affidavit says a tractor was in front of the semi on the eastbound shoulder.

The affidavit says Anderson attempted to swerve to avoid a collision, but struck the tractor. The semi and attached trailer then tipped onto its side and slid into the westbound lane.

A westbound Ford pickup driven by Patrick Stauffer then struck the trailer, leading to Stauffer’s death.

A trial has been set for October 15 with a pretrial hearing on September 19.
