State filing in medical marijuana suit casts doubt on validity of nearly 100,000 signatures

Secretary of State Bob Evnen has filed an amended cross-claim in the Lancaster County lawsuit against the two medical cannabis initiatives, saying new information uncovered in the Attorney General’s investigation requires the court to determine validity of thousands of signatures for each of the ballot questions.

In the filing, Evnen says in addition to two cases already made public, the AG’s office has found circulator fraud and/or malfeasance by notaries across 71 counties in addition to Hall County, when it came to circulator’s oaths and proper notarizations.

Because of the investigation, Evnen says there is serious doubt as to the validity of approximately 49,000 signatures on both the medical marijuana Legalization and Regulation petitions.

In response, Nebraskans for Medical Marijuana issued a statement saying it was appalling for the state to work to silence and disenfranchise thousands of Nebraskans based on primarily unsubstantiated technical issues.
