A Scottsbluff man serving 90 years to life in prison for the death of a 23-year-old nearly four years ago has lost a direct appeal to the Nebraska Supreme Court.

In his appeal, Gregory Moore argued the district court erred by admitting evidence of a prior assault during his 2nd Degree Murder trial for the stabbing death of Fernando Camacho McBride in November 2020.

In a pretrial motion, Moore attempted to prevent introduction of evidence from a March 2020 assault on a former landlord that also involved a knife.

The district court rejected the motion, saying based on similarities between the two attacks, evidence from the March incident was independently relevant and admissible for the limited purpose of proving motive, intent, knowledge and absence of mistake or accident, and was not unfairly prejudicial.
