An Overton man has been arrested for driving under the influence while children were in his car.

Mauricio Calmo-Calmo, 30, is charged with DUI Alcohol – 3rd Offense, Driving Under Revocation, and Transporting a Child While Intoxicated.

According to an arrest affidavit, Lexington Police Officers were dispatched to the 1100 Block of East 6th Street regarding a motor vehicle accident on October 14, 2024.

Police say it appeared that an SUV had struck a parked car.

Officers contacted Calmo-Calmo, while he was holding two young children.

The affidavit says he at first denied driving the SUV before admitting that the SUV was his wife’s and that he was driving it.

Calmo-Calmo agreed to do a field sobriety test, which showed impairment.

Police say inside the SUV, only one child restraint seat was properly installed, while the other seat was not buckled and was sitting on the floor of the vehicle.

A check of his license showed two prior DUI convictions.

He was arraigned on the charges on October 16, 2024.

His bond was set at 10% of $50,000, which has since been posted. His next hearing is scheduled for October 31, 2024 at 9:30 A.M.

This is the third time within a year Calmo-Calmo has been in trouble with the law for DUI.

He had been arrested for DUI in late December 2023. He later took a plea deal and was sentenced to probation in May 2024.

He was then arrested again for DUI in June 2024.

That case is currently pending in Dawson County District Court.
