Hilgers joins another suit over Biden student loan forgiveness

Attorney General Mike Hilgers joined a coalition Thursday of 11 state attorneys general suing the Biden Administration over its latest illegal attempt at student loan forgiveness.

The lawsuit was filed today in the United States District Court for the District of Kansas Wichita Division.

“In Biden v. Nebraska, the Supreme Court made clear that the President cannot unilaterally cancel billions of dollars of student debt. President Biden has refused to accept the Nebraska decision and is now trying an end-run-around it, following a different pathway to the same illegal result. Today, we joined a lawsuit that ensures this latest lawless action does not go unanswered,” stated Attorney General Mike Hilgers.

The multistate lawsuit argues that the U.S. Department of Education doesn’t have the authority to alter student loan repayment plans, essentially canceling more than $156 million in student loan debt. It also argues that the U.S. Supreme Court struck down an earlier version of Biden’s illegal student loan program last summer.

The Court ruled that the program violated federal law and that only Congress can authorize the forgiveness of student loans—which requires spending taxpayer money to do so.

The coalition is made up of attorneys general from Nebraska, Kansas, Alabama, Alaska, Idaho, Iowa, Louisiana, Montana, South Carolina, Texas, and Utah.
