Lex arrests now under federal indictment

    Two people who were arrested in a Lexington residence last month, following the controlled delivery of a package of Methamphetamine,  have now been indicted on federal charges in the case.        Nestor Gomez-Orta, age 36, and Mellenize A. Utterback, age 30, are charged with possession with intent to distribute 500 grams or more of methamphetamine (mixture) on or about April 25, 2022.  The penalty if convicted is not less than 10 years’ and up to life imprisonment, a $10,000,000 fine, a five-year term of supervised release, and a $100 special assessment.  Count II charges Utterback with felon in possession of ammunition.  The penalty if convicted is 10 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.  There is also an allegation to forfeit United States currency seized on or about April 25, 2022. 

.   The investigation began as a Nebraska State Patrol investigator was advised of a suspicious package being sent from California to a Lexington residence.  The package was intercepted by the United States Postal Inspector and a controlled delivery of the package was made to 408 Rimpley Lane.  There were 5 individuals and two juveniles in the residence at the time.  

    The Nebraska State Patrol Swat Team executed a search warrant of the residence.  At the time, Utterback and Gomez-Orta, were taken into custody for possession of two packages that contained about 5 pounds of Methamphetamine.   Also located during the search were about 1,000 small blue pills believed to be Fentanyl in a safe along with more Methamphetamine.  There was also a large amount of U.S. Currency seized along with 6 knives that were more than 3″ in length and a compound bow.   Numerous items of paraphernalia were also discovered including pipes, bongs, rolling papers, phones, scales, computers, marijuana grinders and packaging material.
