Kearney woman charged with DUI following Car-Tractor collision east of Lexington

Lexington, Neb. — A Kearney woman was charged with driving under the influence of alcohol-first offense following a car-tractor collision three-miles of east of Lexington on Highway 30.

The collision occurred Thursday about 5:25 p.m. when the driver attempted to pass a tractor, but noticed an oncoming car and collided with the back-left wheel of the tractor, causing a traffic accident.

The driver, identified as 35 year old Danielle Garduno of Kearney, declined transport for medical treatment by Lexington Volunteer Fire & Rescue, stating that she did not hit her head and did not have any injuries from the accident.

A Dawson County Sheriff’s Deputy, suspicious that the woman was under the influence, performed specialized impairment tests including a blood-alcohol test (BAT) which confirmed his suspicion.

Moments later, the owner of the vehicle arrived on scene and said she had not given Garduno permission to drive her car.

Garduno made her first appearance in Dawson County Court on Friday and was read the charges of DUI-First Offense with a BAT of .15+; Unauthorized Use of a Propelled Vehicle and Reckless Driving.

She was released on her own recognizance. Garduno’s next appearance in court is set for July 30 at 9:30 a.m.
