Charges Dropped in Gering Strangulation Case

Charges have been dismissed against a 31-year-old Gering man arrested last summer who was set to stand trial this month on felony charges of Assault by Strangulation and 2nd Degree Assault.

David L. Hernandez was arrested last summer after reportedly grabbed the victim by the throat, slammed her to the floor, and proceeded to hit her multiple times in the ribs, face and arms with pieces of plywood.

Hernandez was slated to stand trial Wednesday in District Court, but Judge Andrea Miller signed off on the state’s motion on March 20th to have the case dismissed without prejudice; which means the case could be retried at a later date.
