Prosecutors are seeking a Habitual Criminal enhancement for a Scottsbluff man arrested on a drug distribution charge Monday evening.
49-year-old Benjamin De Los Santos III was arrested after a warrant was served on a Scottsbluff residence, and court documents say he was caught with 25 grams of meth inside his backpack.
He’s charged with Possession of Meth (10-27 grams), Possession of Drug Paraphernalia, and the Habitual Criminal enhancement- which could result in a mandatory minimum of 10 years in prison.
NDOC records show that De Los Santos was sentenced to 3 to 6 years in prison in 2013 for Delivery of an Exceptionally Hazardous Drug, and 4 to 6 years in prison in 2020 on a Meth Distribution conviction, both out of Scotts Bluff County.
He was arraigned on his latest charges Wednesday in Scotts Bluff County Court.
