A 22-year-old Gering man who was supposed to stand trial last week on a charge of first degree forcible sexual assault has had his case dismissed without prejudice.
Donovyn Marshall was arrested by Gering Police in July after a woman told them she had been sexually assaulted, but Marshall denied the allegations when he was later questioned by officers.
During a November 16th hearing, County Attorney Dave Eubanks filed the motion. Dismissed without prejudice means that the state can file charges again at a later date.
